Abstract

PROBLEM: The inquisitive system consisted of an authoritarian and centralized regime, characterized by its secretive nature during the investigative phases that would contribute to the clarification of a crime. The adversarial system allowed for the implementation of a democratic and decentralized regime, based on its public and oral nature, in order to guarantee the inherent rights of human beings. OBJECTIVE: To compare the inquisitive and adversarial systems, unraveling the importance of each and their contributions to criminal law and criminal procedure law. METHOD: was focus on the historical perspective, developing relevant aspects and the evolution of the systems in comparison with the current national legislation. RESULTS: The adversarial system allows the parties within a process to present arguments that validate and refute the hypothesis proposed for their defense, so the judge's role is limited to presiding over the proceedings in search of the truth for the application of justice. CONCLUSION: Criminal law is constantly changing and tends to adapt to the needs that arise at specific moments in history. However, its evolution is constant, allowing for a balanced system that guarantees fundamental rights.
