We have worked with notions that can still be developed in greater depth, as is the case of sound reasoned criticism. OBJECTIVE: to clarify the idea of motivation of the sentence in terms of the argumentation theory. METHOD: This is a qualitative research that analyzes the rational structure of the argumentation of the judicial sentence. It is sustained as a hypothesis that the models of argumentation theory help to understand the structure of the motivation of the sentence. RESULT: shows that the justification of the sentence is a rational structure analyzable under the optimum of the argumentation theory. CONCLUSION: it is stated that it is necessary to train judges in the rudiments of such theory, so that they can provide better structured and convincing sentences, within the constitutional rule of law.
