Abstract

PROBLEM: The constitutionalization of the criminal process aims to shift the system of Criminal Procedural Law known until these days, through the application of the constitutional principles enshrined in the Magna Carta, which aim to protect the inherent rights of every human being, avoiding their violation and the existence of threats. OBJECTIVE: To reflect on the evolution and repercussions of constitutionalization in the criminal process, in order to understand its importance and legal and social impact. METHOD: An inductive, deductive, and historical methodology will be used. RESULTS: The constitutionalization of the criminal process seeks the protection of legal goods and the consecration of the rule of law. CONCLUSION: The analysis of the constitutionalization of the criminal process allows understanding the influence and transformation of judicial practices and the need for adaptation to solid foundations in defense of fundamental rights.
