Abstract

OBJECTIVE: to analyze whether there have been constitutional reforms that modify penal systems at the Latin American level, and if they exist, to verify the effect of constitutional reforms on criminal law and at what point the reforms modify penal systems, in particular: Argentina, Venezuela, Colombia and Guatemala, and the consequent influence of international treaties. METHOD: the analytical, inductive, bibliographic, legal and documentary method was modified. RESULTS: Through the analysis of the different constitutional reforms in Latin America, specifically in the countries taken into consideration as a sample, it has been possible to notice that after the constitutional reforms that have taken place in each country, penal reforms have been produced and it has been approved. some international treaties or conventions. CONCLUSION: Latin American constitutionalism is a process that is born outside academic entities, whose genesis can be found in the social and political movements that have arisen in the American continent, specifically in Spanish-speaking countries, the constituent processes, reforms through congresses with ratification in popular consultations etc., with which reforms have also been made to ordinary law, especially criminal law, where a standard criminal code has been promoted, which has served as a guide in some countries that have implemented it.
