Abstract

PROBLEM: Contemporary criminal law represents a multidimensional and updated approach in the field of criminal law. It considers aspects such as the prevention and fight against crime, victim support, and the balance between security needs and the protection of fundamental rights. Restorative justice is a key element, as it seeks to promote repair, reconciliation, and restoration of relationships affected by crime. This approach involves the participation of victims and offenders in the conflict resolution process. OBJECTIVE: To reflect on the theoretical and ethical foundations of Contemporary Criminal Law and the alternatives to ensure an equitable and crime-preventive penal system. METHOD: Inductive, starting from a particular notion, deductive, establishing particular and historical elements for the development and evolution of Criminal Law. RESULTS: Contemporary criminal law is guided by different disciplines such as sociology, criminology, and criminal policy. This allows for the development of prevention, intervention, and treatment strategies for crime, providing a greater understanding of criminal phenomena and favoring the adoption of more effective and humane measures in the criminal field. CONCLUSION: Contemporary criminal law recognizes the importance of crime prevention as an essential component of criminal policy. This implies the implementation of measures aimed at addressing the underlying causes of crime, such as inequality and social exclusion. Likewise, contemporary criminal law emphasizes the protection and attention to crime victims, including the recognition of their rights and the provision of adequate reparation for the harm suffered.
