Abstract

The essay developed consisted of making an analysis of the social function of the prison sentence, for which the starting point is to determine those phenomena that have as a consequence the existence of a deficient prison system, due to the loss of control of the authorities This is because, although it is true that Guatemalan criminal legislation allows the application of criminal substitutes as a tool for the rehabilitation of the offender without necessarily serving a prison sentence in its entirety, at present the country's prisons are saturated due to excessive use of custodial measures, which has led to them being schools of crime.
